Litigation. Mark has over twenty-five years experience handling a variety of civil litigation matters and over nineteen years of experience representing national and regional lenders in commercial banking disputes and representing contractors in a multitude of actions, including public and private mechanic’s lien actions. Two cases Mark has handled for national banks have resulted in favorable appellate decisions that are now standard setting cases. Mark tries, arbitrates and handles appeals of in state and federal courts, including tax court. In Lyeth v. Chrysler Corporation, Mark successfully defended the Constitutionality of the mandatory arbitration program of the New York State Lemon Law before the federal district court and the Second Circuit Court of Appeals, and received the largest attorneys’ fee award ever granted under that law.
Entertainment Law. As an entertainment attorney, Mark has represented a variety of clients in the music, film and publishing industries since 1987. Mark is a member of the Executive Committee of the Entertainment and Sports Law Section of the New York State Bar Association and, along with several members of the firm, was counsel on Woodstock ’99. In 2001 Mark served as a writer and Producer of a feature film, the romantic comedy “Checkout”, currently being sold and distributed throughout the world.

Professional Experience
After an internship with the New York Appellate Division in Albany, New York, Mark joined the Exxon Corporation litigation department where he worked both in Houston, Texas and in New York City, handling a wide variety of commercial litigation matters. Mr. Costello joined Boylan, Brown's litigation department in 1986.

Mark is a member of the Monroe County Bar Association and the New York State Bar Association, in which he was a member of the Executive Committee of the Entertainment and Sports Law Section.
